【全国管制法令】若收入少过2千 雇员不可被扣薪

林伟杰发表有关扣除薪水是否合法的推文。

 

根据1955年劳工法令,除非是法令赋予的授权,否则,在未来14天国内施行的行动管制令,雇主不得从扣除低于2000令吉以下收入雇员的薪水。

大马律师公会宪法委员会副主席林伟杰发推文,指在该法令第24合法扣除条文中,其中在第24(2)(d)条文阐明,在其他书面法律所允许的扣除下,雇主才能合法扣除雇员薪水。

根据第91(c)条文,雇主在上述法令以外扣除雇员的薪水,属于违法,在第99A条文可被判禁罚款一万令吉。

不过,在第24(7)条文下,公司总裁应雇主或特定级别的雇主的申请,向雇员扣除作某用途的款项,不过,总裁可定下他认为适合的条件。

他在发表推文有关在18至31日期间,我国施行限制行动期间雇员是否可被扣除薪水时,这样回应。

同时,他也上传数页劳工法令的相关条文;不过,他强调,1955年劳工法令适用于2000令吉以下薪水的雇员或工友。

至于薪水高于2000令吉的雇员,他建议,若在危机期间需要减薪的话,雇主与雇员需探讨当时签署的雇用合约。

“雇主也可以与雇员商讨此事以拯救事业,但是,若此事没列入合约,雇主绝对不能强逼雇员这样做。”
